Mumbai RTO has introduced a new set of rules which make it mandatory for a two-wheeler owner to submit a written affidavit declaring that he/she will wear a helmet while riding a motorcycle. The owner will also have to present a written affidavit from the dealer/seller stating that he (dealer/seller) has sold a helmet along with the two-wheeler. The vehicle will be registered only once the owner submits the two written affidavits.

“The buyer will have to give us a declaration on oath that he will wear a helmet and the seller will have to give an affidavit declaring he has sold a helmet along with the two-wheeler. Without the two, we will not register the vehicle. We have been accepting affidavits while issuing driving licences wherein candidates would pledge that they will wear helmets. But the rule is not being implemented,” said an Andheri RTO official told TOI.

Instead of complicating the registration process by adding new list of required documents, we feel that authorities should work towards enforcing the existing law. Besides the penalty, we are still not aware of the action that the RTO would take against the offenders. But the question remains as to how many people would actually wear a helmet just by signing a piece of paper? How many people would legally pay the fine for not wearing a helmet and how many would not try to find a way out by offering a bribe?

  1. That’s a very. very valid statement Soham. Such mindless rules are just another proof that the authorities are incapable of enforcing the law, and won’t spare any chance to pass on any responsibility / liability to the citizens

  2. I am OK with giving a written acknowledgement that I will wear a helmet, but I am not ok with having to purchase a helmet from the dealer, I have a better helmet that is perfectly fine. Why should I have to purchase a helmet from the Dealer. Even if I have to purchase a helmet, it’ll be from where I want. I shouldn’t be forced to purchase it from the dealer. I scream violation of my rights, my right to purchase any commodity from any market. I scream unfair trade practices
